Israel's State Prosecution has appealed against the verdict in IPC’s favor given by Judge Moussia Arad of Jerusalem District Court (see related article). The landmark verdict ordered the State Prosecution to hand over to IPC all files from the past seven years in which the State Prosecution decided whether to indict people for“insulting a civil servant.” The District Court ruled that granting IPC access to the files was necessary in order to enable Mr Elizur Segal,who has been accused of “insulting a civil servant,” to establish his defense that the law is being applied to him in a discriminatory fashion. IPC is defending Segal. The District Court ruling has attracted widespread interest among defenders of civil rights. Israel’s Public Defenders’ Office, a branch of the Ministry of Justice, Israel’s Association for Freedom of Information, and the Association for Civil Rights in Israel are considering filing amicus curiae briefs on Segal’s behalf in the case.
Atty. Shai Nitzan, Deputy State Prosecutor for “Special Affairs,” is in charge of indictments for “crimes of expression,” decided to file an appeal.
